Aliaksei Mihno was convicted under Art. 370 of the Criminal Code ('Desecrating state symbols') for removing a state flag from a building.

From the end of October 2022, he was kept in custody. A month later he was transferred to home confinement. After the verdict of the district court, he was taken into custody again, and now he is in a remand prison.

On December 13, 2022, in the Ivacevičy District Court, Judge Siarhei Kukhatskavalets heard the criminal case. He found the guilt of Aliaksei Mihno fully proven and sentenced him to 12 months of imprisonment in a general-security penal colony.

On February 17, 2023, the Brest Regional Court considered the defense's appeal against the sentence. The prosecutor said that the severe punishment is justified by to the fact that the convict had commited the "crime" (that is, removing a state flag from a building) while being intoxicated with alcohol (which was viewed as an aggravating circumstance in the case). Besides, Mihno was previously brought to administrative and criminal responsibility—that was another reason for the severe punishment. As a result, the panel of judges of the Supreme Court (headed by Judge Sviatlana Kramianeuskaya) upheld the sentence.

On March 3, 2023, Aliaksei Mihno was included in the 'List of Belarusian citizens, foreign citizens, and stateless persons involved in extremist activities'.

At the end of October 2023, he served out his sentence and was released from prison.
