Alena Dzmitryeva was detained on August 6, 2023, under Article 342 of the Criminal Code (organization and preparation of actions that grossly violate public order, or active participation in them) in the so-called "round dance case". She was returning from Poland to Brest. During passport control, the border officials took an interest in the fact that she was born in Ukraine. Consequently, she was detained.

After the initial administrative hearing, Dzmitryeva was arrested for 15 days under Part 2 of Article 19.11 of the Administrative Code for two reposts on Telegram. She was sent to a pre-trial detention center to await the trial.

In October 2023, the Investigative Committee published a press release. It claimed that on September 13, 2020, during the protests, the woman "ran out into the street, danced and filmed what was happening on a cellphone," thus "actively participating in group actions that violated public order."

On November 20, 2023, the Brest District Court sentenced Alena to three years of restricted freedom under home confinement ("domashnyaya khimiya"). She was found guilty under Part 1 of Article 342 of the Criminal Code (active participation in actions that grossly violate public order). The verdict was announced by Judge Volha Sukhadolskaya. Following the announcement, the woman was released in the courtroom after serving three and a half months in custody. Considering the time spent in pre-trial detention center, she will have to serve roughly two and a half years of home confinement.
